ACCEPTANCE OF TERMS THROUGH USE By using this site, you signify your agreement to all terms, conditions, and notices contained or referenced herein (the "Terms of Use", "Terms of Service", or "TOS"). If you do not agree to these Terms of Use please do not use this site. We reserve the right, at our discretion, to update or revise these Terms of Use. Please check the Terms periodically for changes. Your continued use of this site following the posting of any changes to the Terms of Use constitutes acceptance of those changes.

THE SERVICE is defined as any and all services provided by Brickboard.com(Jarrod Stenberg Consulting) including, but not limited to, the internet website named "brickboard.com."

AGREEMENT TO ACCEPTABLE USE POLICY (AUP) You agree to abide by Brickboard.com's AUP, including but not limited to, agreeing not to use this site for any unlawful purpose. A copy of the AUP, which you should review, can be found below.

BRICKBOARD.COM, ITS AFFILIATES, EMPLOYEES, AGENTS, CONTENT PROVIDERS AND LICENSORS SHALL IN NO EVENT BE LIABLE FOR ANY DAMAGES OR LOSSES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL OR PUNITIVE DAMAGES, RESULTING FROM OR CAUSED BY THE SERVICE OR ITS CONTENT, INCLUDING, WITHOUT LIMITATION, LOSSES RELATED TO: YOUR USE OR INABILITY TO USE THE SERVICE; ANY ERRORS, OMISSIONS OR DEFECTS IN THE CONTENT; OR ANY INTERRUPTIONS, DELAYS IN TRANSMISSION OR COMPUTER VIRUSES. MISCELLANEOUS Brickboard.com may modify, suspend, discontinue or restrict the use of any portion of the Service, including the availability of any portion of the Content at any time, without notice or liability.

These Terms of Service will be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflicts of law provisions. You hereby agree that any cause of action you may have with respect to the Service must be filed in the federal or state courts located in Ramsey County, MN., within one year after the cause of action arises or the cause is barred.

TERMINATION Brickboard.com reserves the right, in its sole discretion, to terminate your access to all or part of this site, with or without notice.

TO MAINTAIN QUALITY OF SERVICE, THE SERVICE IS CONSIDERED A PRIVATE SITE (AS IN "PRIVATE CLUB"). THE SERVICE IS NOT A PUBLIC FORUM. IF YOU DISAGREE, DO NOT USE THE SERVICE.

Acceptable Use Policy (Guidelines,Liability,Enforcement)

The Brickboard administrators reserve the right to move/delete any material deemed unacceptable or take any other appropriate action under the following guidelines:

Participants in the Brickboard forum may not post any information that is libelous, defamatory, obscene, pornographic, abusive, or in any other way illegal. We will not tolerate racial, ethnic or religious slurs or other language that is deeply and widely offensive.

Participants agree not to harass other participants. Participants are prohibited from posting any information that discloses private or personal matters concerning any person.

Participants in the Brickboard forum assert that the material is his or her own and is free of copyright or other restrictions. The participant also grants Brickboard an irrevocable, royalty-free license to reuse the information in any medium or form.

All written material is copyrighted to Brickboard.com and its proprietors. Participants may not copy any material originating from this site to any third party publication without prior consent.

The Brickboard cannot and does not guarantee the accuracy or completeness of any information posted anywhere on this site. The Brickboard does not endorse and is not responsible for any information within the service. Opinions, advice and all other information expressed by participants in discussions are those of the author.

The Brickboard is not responsible for the content of these messages. The author of any volunteered message shall remain solely responsible for the content of their messages.

Participants may not collect ANY information on users for use outside of the context of this site. Use of personal information obtained from this site, whether by browsing or by subscription to e-mail notices, for personal or commercial gain is strictly forbidden. For example, you cannot extract e-mail addresses to advertise your company nor can you do so to advertise your web site.
Any evidence of such activity will result in termination of the violators access and may also include: notification of your service provider, notification of the appropriate agencies in your state, legal action.

Participants must not engage in disruptive behavior. Participants who intend to disrupt the services provided by this site will have their access to the service terminated. Should a terminated user persist to post regardless of being asked to leave, the matter will be pursued as harassment. Disruptive actions include: numerous and consecutive posts, attacks against the service itself, probes of the server, and threatening e-mails to administrators or any participant of the service.
Any attempt to use these services in any way outside of the intended use will be construed as abusive behavior and pursued accordingly. This includes any attempt to extract from services, alter, or otherwise undermine services as provided. For example, any attempt to post to any service on this site using a means not provided on the service itself will be considered an abusive act.
Any commercial activity that is not sanctioned by agreement with the owners and operators of this site will be billed to the offending party at whatever rates the owners and operators of this site find appropriate.

Unauthorized Usage Fee

All material is copyrighted except where indicated. Any unauthorized use of the copyrighted material provided by this site will result in fees, legal action, or both. Fees will be assessed at a minimum of $100 per-page and per-use. We will also pursue the termination of unauthorized usage legally, if required. Outside that expected from spider engines and end-users, if extraction of data from this site results in interruption of service of any kind, the offending party will be billed for any losses incurred including any expenses required to restore service.

Additional notes on spam

Spam is unpaid advertising, chain letter schemes, frequent posting soliciting products, flooding (posting the same or similar message again and again), or extending an ad expiration beyond the parameters provided by the classifieds service. Any such action will result in aggressive efforts to identify you, we will alert your ISP of your activity, you will be banned from the site and your identity will be exposed to the legitimate users of this forum.

Spammers will be reported to their service provider, the backbone provider for the service provider, the USPS, net-abuse@nocs.insp.irs.gov and nfic@internetmci.com(The National Fraud Information Center).

Chain letters are a form of gambling, and sending them through the mail (or delivering them in person or by computer, but mailing money to participate) violates Title 18, United States Code, Section 1302, the Postal Lottery Statute.
