850R rear-ended in Las Vegas…Progressive says “bumper fits fine” 850 1997

Hello Ladies and Gents,

I was rear-ended in Las Vegas on September 12th in my ’97 850R wagon The impact was high (92 Jeep Cherokee) and struck the top of the bumper and the rear door. My insurance company, Progressive, replaced the rear door with a used-OEM and the bumper with a new-OEM.

It has been three weeks now and they (the shop and the Progressive) say the car is complete. Upon arrival, the rear bumper cover appeared low. Upon measurement, the gap between the quarter panel, rear trim, and rear door shows a consistent 8mm of gap, which looks like alot. I have photos of the car prior to the accident, and the gap is almost none (maybe 2 mm at the most).

Both Progressive and the shop say that it sits fine and there is no adjustment that can be made to make it fit right. I argued with them for over an hour at the shop that they have a duty to find a way. The refused, stating that the OEM bumper fits even all around. They said it looks good to them (then again, they drive a Chevy Lumina).

Do any of you have any ideas of why it is sitting low? Is it possible that the bumper was not manufactured correctly? The shop states there was no damage to the absorber/reinforcement assembly, but I did not see this myself to validate their claim. Please, I need any input you can provide.
