What position of air box thermostat flap could cause emmissions test fail? 200 1988

I have removed the air hose from the engine side because I think the air box thermostat is bad. I have also taped open the other fresh air flap (not the one coming from the air hose). I heard that disconnecting the air hose could cause me to fail the emmissions test. If this is true, is there a position that the thermostat flap (air hose one) should be in so the emmissions are not affected? Also, is it O.K. to always have the fresh air flap open and does this in any way negatively affect the emmissions? Thanks.
