M41 & OD oil level. 120-130

Although I can get the solinoid on the recenlty installed D type to click, and the lock out seems to be working properly, it simply does not engage in OD out on the road. I have a toggle to ensure it's on.
In the Haynes under "Specifications" (Pg. 97) it says that the oil capacity is 3.38 US pints. However in the text of the very same chapter under "Overdrive - refitting" (Pg. 118) it says, "Finally, don't forget to fill the unit with oil until level with the bottom of the filler plug hole in the side of the case".
By the looks of the location of the plug I'm sure these two amounts are different.
I put in the 3.38 and I'm wondering if this could be related to why the OD will not engage?
