V70 tailgate latch V70-XC70

The latch on my v70 has failed.

A few weeks ago it would not close without slaming it and I began to notice that bits of plastic were dropping out. Now I can't get it open i think that a piece of plastic has come off and is keeping the latch from disengaging. Anyway, how would I open the tailgate --- the lock is fine it's just the latch that is jammed-any ideas?
