Failed DMV Inspection S70 1998

My 98 S 70 which has had the IPD upgraded ECU installed for more than 3 years recently failed inspection because the DMV scanner was "unable to communicate" with the ECU. Last time through with this ECU installed, it passed. Apparently there is a difference between "unable to communicate" and "not ready". The car runs fine and get good gas mileage. One Volvo shop says the ECU has failed and should be replaced. Another says the ECU has not failed but it will be nearly impossible to get it to cycle to "ready". This shop says that if the ECU had failed, the car would run poorly if at all. We have completed Volvo's recommended drive cycle several times with no luck. Their is continuity in the wiring between the ECU and the OBD II port. Volvo's own website suggests that cars having in excess of 100K miles (this one does) may be "sensitive" when recycling the ECU after a check engine light has been on or the battery has been disconnected. Maybe we are going down the wrong track trying to get the ECU to recycle to "ready" when the scanner "cannot communicate".

What to do now????????? All suggestions cheerfully accepted.
