Does the CE lamp light up when you turn on the ignition (before starting car)?

In Illinois if the CE light simply does not work, I understand that the vehicle will be failed for "malfunction indicator not working" or similar.

That is, is the problem in the diagnostic system rather than the car?

Also some codes like ABS sensor codes may not set the light, at least until they happen several times.
