Rear Brakes S40 2001

Apparently Volvo has not resolved the dilemna of the magically disappearing brakes.

I have a 2001 S40 with 15,500 miles and was recently made aware by dealer that I have less than 1mm left on the rear brakes. They want to charge $175 to replace. Why should I pay for a defect product?

Has anyone had any success in making the Volvo replace the brakes under warranty?
