S40 Emissions tests/Euro imports S40-V40

Two questions, thanks for all replies.

Dealers in my area (NY tri-state) are telling me that no, the S40 isn't being sold in the US with a manual transmission because it doesn't meet emissions requirements here. It's not that I don't believe them, but I've seen S40s with manual trannies in this country before... Does anyone know any more about this? Is it just a NJ/NY/CT problem? Is there any way to modify a European import for use here?

I've read about the S40 T4 (200 bhp, sport suspension etc.) and that it's only for sale in EU markets. Does any one know any more about this model? Any idea whether it would pass inspection here in the US if purchased abroad?
