auto transmission whine when cold issue V70-XC70 1998

I am getting a whine when 1st driving the car for the day. Just got the car used off ebay and it has 112K miles. Anybody experience this, is it a potential issur or not? Previous owner records show similar issue brought up to dealer a couple of times over the previous years with no apparent diagnosis other than a possible cold air pump, but nothing about transmission itself. I am getting ready to do a flush of the tranny as a buyer inspection showed dark fluid. Any comments on doing flushes (I am planning on getting the flush kit from IPD). Is it true you only get about a third of the fluid if just draining from the drain plug?
