Tire sidewall question S80 2002

A small piece of the rubber on the sidewall of a brand new tire is missing - looks like someone too a potato peeler to it.

I just bought it as a used certified car - and the dealer had put the brand new tires on it (not my choice they're cooper tires, but the approp speed rating and I figured I'd a get a year out of them bfore getting something else)

So I looked at it and brought it to a tire store today (it's fresh damage)
and was told that since the cords aren't showing that it's a cosmetic issue only, and the tire is safe. It was maybe a square in area and maybe a 1/16th inch thick piece missing.

Is it really safe, or should I buy a replacement anyway?
