Seized Engine on 2001 V70 T5 V70-XC70 2001

Sorry just registered and do not have password yet. We have a 2001 V70 T5 with approximately 60,000 miles. We have had all periodic Volvl maintenance performed by the dealer that sold us the car. Some of the maintenances were 1000 miles or so late. most on time, or early. The dealership has this information in their computer.

The most recent maintenance to replace brakes..again resulted in a seized engine during the test drive.

The extended warranty vender has refused to pay because upon disassembly the engine was found to have sludge. They will pay for mechaical failure, but this problem was due to lack of maintenance.

According to the service dept. Volvo does not have any requirements to flush the engine periodically. Would the technician be able to determine sludge might be a problem when changing the oil?

Help, I need some ammunition to try to get some warranty relief or relief from Volvo. Is this a problem with the T5 that has not hit the public? I found one mention on the iNet that indicates a problem associated with a PC valve..
