DREADED BEVEL gear???? V70-XC70 2000

Ok so the saga get more depressing... I'm the guy whose wife hit a pothole and took out a front tire. So news tires and an alignment were required. You know how you cant have missmatched tire sizes. I am also the guy with oil leaks and a massive one last Fri night. Well the dealer thought it was the seal between the tranny and bevel gear but called today to say that the bevel gear vent was spewing because the tire shop had put different size tires on..I guess the fronts at 60's and the back 65's or the other way. The bevel gear oil is fried black. He is not saying it is shot yet but they wont test drive it until the correct tires arrive. The dealer says this is 3000$. So now what do I do. What if it runs for 6 months and then dies or on a trip?? Im taking my lumps but not to happy.
