Ask the mechanic if the code for the mode switch came back, this could have been a one time occurance and left over from who knows when.
I would bet on a sticky solenoid. Give your tranny flush time to work, it takes a while to disolve the gunk that was in there.
Does the tranny shift to 3rd and 4th normally? 1st to 2nd does take a lot of pressure and a cold tranny will take a while. Check the ATF level immediately after cold start and check the fluid - it must be at the full mark (cold). A hot reading can sometime be skewed to over full if the ATF is very hot.
