Most states don't have state inspections (other than those on the east coast and (oddly) Wyoming for some odd reason, state population of about 350,000 (once lived there).
ABS not being functional does not effect the cars standard brake operation thus it's not really a true safety issue IMHO although some might argue that (those who rely on ABS to stop them "safely" on snow, ice for example).
In winter, I put 4 good Blizzaks on my old RWD Volvo and I can stop my car faster on a slippery, snowy road than I can stop a FWD Volvo (same conditions)with ABS functioning. One can do fine w/o ABS.
