I think doubling the gaskets would be OK as long as the studs have plenty of thread.

I had a similar problem with an aftermarket header pipe that was not flat across the two downpipes, but was "high-centered" about .050" where the pipes are close together.

This was the 2nd of 2 shoddy headers, so I went with the OE unit — pure quality for about $60 more.
