Catalytic Converter Junk Science 200

Here is my experience today, just want to see what you all think.

I recently purchased a 1990 245 from an old friend. I transferred the tags to me about 3 months ago and passed the emissions testing with flying colors.

Today I took it to have the muffler replaced and my friend who owns the shops says "Come look at this." In place of the converter is a little cherry bomb type muffler.

LSS, I put on a new converter and muffler. The old car is quiet as can be now, but here is the question.

How is it the car passed a tail pipe emissions test a without catalytic converter?

Please don't tell Al Gore.
