Failed Emission in Ca, TAC missing, necessary to pass smog? 200 1988

So I failed smog here in California. NOx was 4 times over the max amount.In the ball-park of 2500ppm.
I've read alot of posts about high NOx here, alot of great info
much appreciated.
So anyway when I bought the car the Thermostatic air cleaner
(hoses, manifold plate)where missing.
So my biannual came up, and the tech wrote on my smog fail
report, Visual Inspection: Tampered.

So I'm wondering even if my car's repaired and passes smog
is it policy to fail a car based on only a missing T.A.C?
