Over-axle exhaust 200

I installed the new OEM Volvo over-axle exhaust a couple weeks ago, and I am having serious issues with the axle pipe contacting the body. There is almost no clearance, and at some speeds the pipe will vibrate against the body constantly, giving me a headache, and probably resulting in very early death for the pipe.

Actually, it isn't hitting the body, per se, it is hitting the "fin" that, in event of an accident, would contact the rear caliper.

Has anyone else had this problem?

Is it safe to cut a notch out of the "fin" to make more room?

I will take pictures when it's not raining.
