a dent and headed to small claims 200 1989

I’ll start by saying “This will be “fun”. (no it wont---will it?)

Few months ago in a parking lot I backed out of my space, stopped and looked again in the side rear view mirror; I had made a slight turn when backing out (exposing the quarter panel to his bumper). To my horror another car directly behind my parking space was backing out suddenly and I could not get away fast enough. When he hit he brick, I shut off and didn't move. His bumper made contact with the bricks left side rear quarter panel. A dent about 8-10 inches long, 2-3 inches wide, very shallow (I didn’t measure it) “appeared“. Its not a big dent but it’s a dent.

Also due to the medium-darkish grey metallic paint on our brick it's actually hard to see, but it's there. Our brick has no other dents, dings or the such on the entire body, It’s been fortunate. Anyway I get out, the other driver did also, we exchange info.

Later on I went to body shops, best (cheapest) estimate was about $425 roughly. So, I contacted his insurance company, they wound up paying me ½ the $425 saying we were both at fault. I don’t see it that way as I was completely stopped when he hit me. SO, I ask the guy to cough up the other half. He refuses, (Trying to sum this up).

I went to file Small Claims today after sending the other guy 2 certified letters, asking him again to pay the balance. He refused, so off to court. Might lose, might win. It’ll cost me $45 to find out. Court date is August 7. I think I have a good chance.

The way the dent looks one can see it was a direct bump, no 'sliding'. I was NOT moving when he hit, thank goodness . Oh btw the other guys car had almost NO damage save for a very small piece of paint transfer off his bumper, as it was his bumper hit the rear quarter panel. He was driving a largish, very new SUV. I forget the make.

What’s the point? Hmm, I’ll let you know after the court date. . I don’t expect to win, I just hope I will. Later.
