Volvo tranny bit the dust 700 86

Allright, I've been having trouble with my car for a few thousand miles, some of you may remember... I replaced the tranny with an 80 240 tranny. Something didn't quite fit right, so I had to wedge some metal to keep the shifter up high enough so it didn't hit the flex joint. Now, it's hitting again, and the flex joint is broken as well as some bolts being worn. I've taken it to my local mechanic, he said he recommends taking it to a mechanic a little further away who has a junk yard of parts to fix it... The guy further away says he will take a look at it and hopefully he can tell me what's wrong and why the older tranny didn't fit right into my car. (BTW, if i had had this discussion with him earlier I would have returned the tranny to the parts people, it's too late now... unless there is some way I can prove that they sold me the wrong tranny and sue them somehow, but I don't know the legalities)
