940 TRANNY PROBLEMS 900 1994

Tranny manufactured by Aisin AW Co. Model #03-71 1208 642.

Had it rebuilt 5 mos ago at 126Kmi. Within a month it began to be slow to upshift into top gear. Revs had to build to ~4K to shift. Thought it was an issue with maladjusted shift linkage. In last two weeks probs have grown much worse. When cold must rev engine to get car to move in reverse or forward. Tranny warms quickly and car can be driven, but shifts are slow, eng revs high. Shift from 1st to 2nd is often slow and revs build before tranny slams into 2nd gear. Also, if I brake sharply, tranny shifts to neutral and revs must build before tranny again slams into a forward gear.

This one is clearly going back to the shop, but I am looking for some opinions as to what specifically might be wrong to support me in what may be a debate about whether this is rework of guaranteed work or not.
