Brake lights only work when running, is the bulb sensor to blame? 900 1993

Discovered that my brake lights will only work when the car is running. When the ignition is off and you press the brake pedal, they no longer work. I'd normally not be too concerned - but I'm pretty sure they legally have to work independent of the ignition system for safety. I'm thinking the bulb sensor is to blame - is this a common symptom when it fails, or is there another issue related to brake light problems?
