Re-read his post, he says that the OD does not re-engage after switching it off. Based on that it, is obviously NOT stuck on - at least not all the time.
He does later say that it appears to be in other gears, but does not really clarify
I totally agree that he ought not to drive it if it really is stuck on, and that driving with the OD on while in reverse is quick death for an M41. I also agree that it's probably not the 4th gear lockout switch.
A stuck solenoid makes sense if it is really stuck on. low oil makes sense if engagement is sporadic
