Not actually accurate. "May" instead of "has" would be more accurate. Some states have attempted to enact legislation requiring it (no surprisingly, those with lots of corn) but I am not sure about their success rate. A quick google search indicate 4 states do have E10 laws.
E15 as the maximum percentage of ethanol in fuel not labelled as E## was a relatively new proposal and was not not legal yet in 2011 but I stopped following it a while ago.
Overall the effect on most cars from E10 is a minor decrease in fuel economy due to the lower embodied energy. Up here in the frozen north, the positive effect is no more need for dry gas! Despite you assertion that enthanol will absorb then release water, it actually will on absorb it until it is saturated...not very much but just enough that I have not had a frozen fuel line since the switch.
