The hole heights may well be different---I hadn't though of that. Otherwise the cases are interchangeable.
I once used an M40 for parts when I cracked the case of an M41 by letting out the clutch with reverse gear not fully engaged. It not only jumped out of gear, but the reverse gear idler and the part of the case it mounts to fell out on the ground. I drove it home that way (The hole didn't extend below the oil level) pulled the trans and swapped over parts from a spare M40 I had. The resulting transmission worked just fine for another 50K+ miles, with no evidence that the oil level was incorrect.
