In some states that preheat is considered part of the emissions testing even though it does practically nothing. Since I have my air flap set for cold air I removed that hose along with the metal plates around the manifold. The testing station caught this transgression and sent me home. Reinstalled the parts and they were happy. Fortunately they did not bother to look inside the air filter box (too much trouble I guess).
