First of all, was the driver of the car cited by police? Was a police report filed? If not, do that right away.

The damage to you was done by the other driver, not by their insurance company. It is the driver (his family) who must make you whole. Determine the cost of doing that, and get several estimates, and tell them that's what you want. Whatever the insurance company says, you are blameless and deserve to be made whole. Tell them also that any attorney costs will be added to the amount charged to them.

Find out the dollar-amount maximum in your court system for a suit filed by you. Here in Harris County, Texas it is $5,000.

It is not unlawful to be a moron, but damages to others must be paid for.
