Sorry, but in this case, I have to agree with the warr co.

Prior to August, did you have the car back in the shop to verify that the freon level was still correct, and that no leaks were occuring? If you can show that documentation, then I think you might have a case. Else, the car was still in the "diagnosis" and "pre-existing condition" state when you bought the warranty, and I see no reason for them to cover it.
