rear fog lights

According to a recent post, in some states apparently it is illegal to have both workable (because of the ability to simulate brake lights?). I do recall fondly a couple of times when I was moving along with traffic ahead, and some a**h*le came charging up on my rear bumper at collision speed, then recoiled in horror when I flipped on the rear fogs...
