My S40 is a lemon S40-V40 2003

Just 4 months ago I leased a 2003 model s40. I was told that it was brand new and was in the customs bond for about a year, hence the reason for a lower price. I must say I made a big mistake. For the past 7 years I have been driving a Honha civic and never had a problem. I decided to upgrade to a volvo and the past 4 months have been hell. From the very first day that I drove it I sensed something was not right (I'm a Mech Eng with expierence in rotating machinery . I reported my finding to the dealer who test drove the vehicle and reported that he did not find any problem.
I personally did not like how the gears were changing especially when you quickly accellerate realease and accellerate again ( e.g coming fast to a corner quickly stopping and speeding off again ). There was a slight missing accompanied by a jerk as the gear kicks in. I intially thought it was due to dirty injectors until a couple weeks later the engine check light came up. I went to the dealer who told me that there was a speed signal error and ordered a new speed sensor. He the re setted the error and for the first time since I had the car it drove perfect. Then 1 month later same problem. They resetted the error then it came back in a few days. They are now telling me that its the Speed Controller.
It has beed 1 month now the dealer has the car and said he is waiting on the parts from Sweden.

I wait disappointed and wondering, did this dealer sell me a used car as a brand new one?
